Special Information Briefing COVID-19 (No. 1): Latest updates and Practical Guide

In light of the state of emergency caused by COVID-19, the Council of Ministers has approved a series of measures aimed at limiting the economic, employment and public health impact.

In addition, business and trade union representatives have proposed a series of measures to the Government that will enable companies to adopt flexible working solutions.

Additionally, we have included a brief practical guide in this note, as a first step to dealing with the employment and contractual problems that are arising because of COVID-19.

Firstly, on Tuesday the Council of Ministers approved the following legislation:

  • Order PCM/205/2020, of 10 March, which publishes the Resolution of the Council of Ministers of 10 March 2020, establishing exceptional measures to limit the spread and spread of COVID-19 by banning direct flights between Italy and Spain.

 

  • Royal Decree Law 6/2020 of 10 March, which adopts a number of urgent economic and public health measures. In order to prevent the spread of the disease and to maintain the social protection of employees and self-employed workers, periods of isolation or infection of workers because of the COVID-19 virus will be treated as a workplace-related illness for the purposes of the Social Security system’s temporary disability assistance. Until now, these cases were subject to the temporary disability regime for non-workplace related illnesses. This amendment means that the Government will now be responsible for the remuneration, which amounts to up to 75% of the regulatory base salary, of affected individuals.

 

  • A series of additional measures have also been passed. These include a number of steps for significant transmission areas, such as the cancellation of closed-door events with more than 1,000 people, and the reduction to one third of the capacity of events involving less than 1,000 people, the closure of educational establishments, and the recommendation that companies adopt measures to facilitate remote working or staggered shifts.
