In its Grand Chamber judgment of 22 October 2024, delivered in Case C-652/22, the CJEU has declared the question referred for a preliminary ruling inadmissible and has held that operators from third States are not entitled to claim equal treatment in EU public procurement procedures in the absence of an international agreement between the EU and that third State which guarantees reciprocity.
