Gonzalez Calvillo, February 29th, 2024 – On February 27, 2024, the Mexican Energy Regulatory Commission (“CRE”) issued new regulations regarding the cross-ownership authorization required under Article 83 of the Hydrocarbons Law (the “Cross-Ownership Regulations”).
The authorization is designed to allow antitrust and energy regulators to analyze the effects on the market and impose ex ante obligations to economic agents or economic interest groups that may potentially use vertical integration as a mean of impairing market access to competitors in different activities of a value chain.
