On June 7th, 2022, the General Import and Export Tax Law (“LIGIE”) was published in the Federal Official Gazette (“DOF”). Following its enactment, the last version of the referred law which was published in 2020 will be repealed.
The LIGIE will enter into force 10 days after the Tax Administration Service (“SAT”) issues general provisions establishing that the systems involved in foreign trade operations are ready to be used in accordance with this new law. SAT is required to publish such provisions within 180 days following LIGIE’s enactment.
LIGIE’s transitory provisions also establish certain timeframes that require the Ministry of Economy (“SE”) to issue technical and legal provisions necessary for its implementation. However, new publications in this regard are still pending.
The amendments to the LIGIE resulted from the International Convention of the Seventh Amendment to the Harmonized Commodity Description and Coding System of the World Customs Organization (“WCO Harmonized System”), effective as of this year.
The new LIGIE includes adjustments to HTS codes of goods, particularly those related to innovative goods, such as multipurpose drones, nicotine supply products, solar panels, among others.
Likewise, the LIGIE provides for rates to determine the corresponding general import and export taxes, based on the classification of the merchandise.
