Criminal risk prevention

The firm is strongly committed to the prevention of criminal conduct and has a Criminal Risk Prevention Committee in charge of monitoring and managing the prevention of crime.

The purpose of this Committee is to prevent or avoid conduct that may result in criminal liability for the Firm and, where appropriate, to facilitate early detection and response to such conduct.

Pérez-Llorca, in compliance with current legislation and specifically with Law 2/2023, of 20 February, on the protection of persons who report regulatory infringements and the fight against corruption, has a comprehensive risk management and regulatory compliance system. Read “Pérez-Llorca’s Internal Information System Policy and Information Management Procedure” (this is currently in the process of being translated).

The Internal Information System integrates the Criminal Compliance Communication Channel and the Harassment Prevention Communication Channel.

This channel is used to direct any reports of acts or omissions that may constitute a serious or very serious criminal or administrative offence.

Likewise, for the purposes of article 8 of Law 2/2023, of 20 February, on the protection of persons who report regulatory infringements and the fight against corruption, the Criminal Risk Prevention Committee is designated as the person responsible for the System before the Independent Authority for Whistleblower Protection [Autoridad Independiente de Protección del Informante] (“AAI”), and the management of the internal information system and the processing of investigation files is designated to the Committee’s Secretary, Mr José Luis Luna García (prp@perezllorca.com).

This designation shall be communicated to the AAI as soon as this authority is constituted in accordance with the applicable regulations.
