Amendment to the Law of the Institute of the National Housing Fund for Workers

The recent Decree amending the INFONAVIT Law imposes new financial burdens on employers by eliminating the suspension of housing loan deductions in cases of worker disability or absence. In this briefing, we analyze its impact and the potential legal actions to consider.

On February 21, 2025, the Official Gazette of the Federation published a Decree modifying the INFONAVIT Law, establishing that employers will be responsible for paying their employees’ housing loans even when they do not receive a salary due to disability or absence. This amendment may infringe upon fundamental employer rights, making it advisable to assess the feasibility of filing an indirect constitutional protection lawsuit within 15 business days of its first application.
