Experience
With more than 20 years of experience, Julio specialises in providing contractual and litigation advice in the financial and real estate sectors. Julio regularly advises domestic and international investors on investments in non-performing assets and all kinds of legal proceedings related to the recovery of such investments.
His main practice areas are the following:
Investment in non-performing assets (NPA)
Since 2013 Julio has been advising investors in the main sales processes of credit portfolios (NPLs) and foreclosed assets (REOs), in addition to individual corporate credits (single names), whether syndicated or bilateral.
Julio has experience advising buyers (opportunistic funds, value-added funds and special situations departments of investment banks), actively participating with the investor in all phases of the acquisition process, from valuation and due diligence to workout. Julio’s experience includes negotiation for the sale and purchase agreement and servicing contracts, if necessary.
Finance Litigation
Julio provides ongoing advice to acquirers of unpaid debt (NPLs) on the drawing up of the legal strategy to recover the credits acquired and leading legal proceedings to recover credits and enforcement of all types of in rem securities.
In recent years Julio has represented many of the main purchasers of mortgage debt before the courts, both in mortgage foreclosure procedures and in various disputes arising from debt acquisition processes (including disputes relating to the validity of the assignment, the exercise of the right of withdrawal of disputed claims, the termination of guarantees and the resolution of disputes arising from the regime of representations and warranties in the contract for the purchase and sale of loans or foreclosed assets). His experience covers insolvency matters, having acted on behalf of creditors in the main insolvency proceedings declared since 2013.
Real Estate Litigation
Julio also has extensive experience in litigation arising from real estate investment and development activity, including the resolution of disputes arising from breaches of sale and purchase, construction, delegated development and sale and leaseback contracts, as well as liability proceedings for construction defects, having represented mainly investors and development companies.
