In any arbitration procedure, the document production phase gives rise, in practice, to various situations that can be addressed in very different ways.

The exact situation depends on the extent of the Arbitral Tribunal’s involvement and the agreements reached between the parties. The option of agreeing on the production system with the Arbitral Tribunal, problems which arise due to the confidentiality of certain documents, and the supplementary application of the IBA Rules on the Taking of Evidence in International Arbitration are just some of the possibilities.
