Speakers at the seminar will include Jesús Gavilán, President of the Eighth Chamber for Civil Law of the Court of Appeal of Madrid; Encarna Cordero, Professor of Civil Law and Of Counsel at Pérez-Llorca, and Cristóbal Rodríguez, Counsel to the State Council. Guillermina Ester, partner of the firm’s Litigation and Arbitration practice, will moderate the session.
With the aim of providing contractors with negotiating tools to avoid litigation, the speakers will analyse the legal measures provided for in contract law to attribute the risk of suspension or limitation of activity or fall in income of tenants of properties intended for commercial use, leisure and hospitality. It will also be discussed whether the loss of customers due the fear of contagion and the aggravation of the economic crisis are facts that may lead to an imbalance of contractual synallagma and justify an amendment of the contract according to the rebus sic stantibus doctrine.
