In 2017, following the approval and entry into force in Spain of Law 39/2015, of 1 October, on the common administrative procedure for public bodies and Law 40/2015, of 1 October, on the legal rules governing the public sector, the European Commission initiated infringement proceedings against the Kingdom of Spain, as a result of several complaints from individuals regarding the regulation of the financial liability of the legislating State for breaches of European Union law.
