The new draft Law on the Right to Housing was finally approved by the Plenary of the Senate on 17 May 2023, and sent for publication in the Official State Gazette (“BOE”) on 18 May 2023. This is one of the reforms included in the Recovery, Transformation and Resilience Plan.
As such, to a large extent, the state legislature follows the approach taken by the Autonomous Community of Catalonia with its Law 1/2022, to tackle the emergency in the housing sector. Among other aims, the new regulation seeks to increase the supply of rental housing, promote public housing and implement new measures to protect against evictions.
