The Court of Justice of the European Union has ruled in its judgment in Case C-392/19 that embedding, by means of the technique of framing, in a webpage of copyright-protected works that are freely available to the public with the authorisation of the copyright holder on other websites constitutes a communication to the public. In particular, the CJEU states that for such embedding to constitute a communication to the public, the measures adopted or imposed by that copyright holder to provide protection from framing must have been circumvented.
