In light of the growing attention to cross-selling by bancassurance operators, in this note, we have analysed this practice and its implications for insurance companies. In particular, using a judgment of a Court of First Instance of Pamplona as a reference, we assess the legality of life insurance linked to mortgage loans, how a declaration of nullity of the loan clause affects the insurance and the standing of insurance companies to appear in the proceedings.
